Terms of Service

1. What RivalFlag Does

RivalFlag is a competitive intelligence service. We monitor publicly available competitor websites on your behalf, detect changes, and use AI to analyse what those changes mean for your business. We deliver this analysis via email digests and a web dashboard.

By using RivalFlag, you agree to these terms. If you don't agree, don't use the service.

2. Your Account

  • You must provide a valid email address to create an account.
  • You're responsible for keeping your login credentials secure.
  • You're responsible for all activity under your account.
  • One person or entity per account. Don't share accounts.
  • You must be at least 16 years old and have the authority to agree to these terms (personally or on behalf of your organisation).

3. Acceptable Use

You agree not to:

  • Use RivalFlag to monitor websites you don't have a legitimate business reason to track.
  • Attempt to overwhelm, abuse, or interfere with our scanning infrastructure.
  • Use the service for any illegal purpose, including violating the intellectual property rights of others.
  • Reverse-engineer, decompile, or attempt to extract the source code of RivalFlag.
  • Resell, redistribute, or sublicense RivalFlag's analysis or data without our written permission.
  • Use automated tools (bots, scrapers) to access RivalFlag beyond normal browser or API usage.

We reserve the right to suspend or terminate accounts that violate these rules.

4. Payment & Billing

  • RivalFlag offers free and paid plans. Paid plans are billed monthly via Stripe.
  • Paid plans include a 14-day free trial. You won't be charged until the trial ends.
  • Prices are listed on our pricing page and may change with 30 days' notice.
  • You can cancel your subscription at any time from your settings page. Cancellation takes effect at the end of the current billing period — no partial refunds.
  • All payments are processed securely by Stripe. We do not store your payment card details.

5. What You Own

You retain ownership of any data you provide to RivalFlag (competitor URLs, account information). We don't claim any rights over your inputs.

6. What We Own

RivalFlag, including the software, design, branding, AI models, analysis methodology, and all related intellectual property, belongs to us. These terms don't grant you any rights to our IP beyond using the service as intended.

The AI-generated analysis we provide is part of the service. You may use it internally for your business purposes, but you may not resell or redistribute it as a standalone product.

7. Data & Privacy

We handle your data as described in our Privacy Policy. By using RivalFlag, you agree to our data practices as outlined there.

8. Availability & Reliability

We aim to keep RivalFlag running reliably, but we can't guarantee 100% uptime. The service is provided “as is”. We may occasionally have downtime for maintenance, updates, or due to circumstances beyond our control.

We do not guarantee that competitor website scans will capture every change. Websites may block automated access, change structure, or go offline.

9. Limitation of Liability

To the maximum extent permitted by law, RivalFlag and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the service.

Our total liability for any claim related to the service is limited to the amount you paid us in the 12 months preceding the claim, or £100, whichever is greater.

The AI analysis we provide is informational only and should not be your sole basis for business decisions. We are not responsible for actions you take based on our analysis.

10. Termination

  • You can close your account at any time from your settings page or by emailing us.
  • We may suspend or terminate your account if you violate these terms, with or without notice depending on severity.
  • On termination, your data will be deleted in accordance with our Privacy Policy.

11. Changes to These Terms

We may update these terms from time to time. If we make material changes, we'll notify you by email at least 30 days before they take effect. Continued use of RivalFlag after changes take effect constitutes acceptance of the new terms.

12. Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
